{"id":27206,"date":"2026-04-22T03:03:20","date_gmt":"2026-04-22T07:03:20","guid":{"rendered":"https:\/\/www.stingfm.com\/news\/hungarian-law-protecting-kids-from-lgbtq-propaganda-illegal-top-eu-court\/"},"modified":"2026-04-22T03:03:20","modified_gmt":"2026-04-22T07:03:20","slug":"hungarian-law-protecting-kids-from-lgbtq-propaganda-illegal-top-eu-court","status":"publish","type":"post","link":"https:\/\/www.stingfm.com\/news\/hungarian-law-protecting-kids-from-lgbtq-propaganda-illegal-top-eu-court\/","title":{"rendered":"Hungarian law protecting kids from LGBTQ propaganda \u2018illegal\u2019 \u2013 top EU court"},"content":{"rendered":"<div>\n<p><strong>The judiciary has found the law in breach of the bloc\u2019s values just a week after Viktor Orban\u2019s decisive electoral defeat<\/strong><\/p>\n<p>Hungary has violated EU principles when it adopted a law to ban children from accessing LGBTQ content, the bloc\u2019s top court has ruled, ordering Budapest to revoke the legislation.\u00a0\u00a0<\/p>\n<p>The EU Court of Justice announced the ruling on Tuesday, less than ten days after Viktor Orban suffered a decisive defeat during the general election to his longtime rival Peter Magyar.\u00a0\u00a0<\/p>\n<p>The legislation in question, Hungary\u2019s 2021 law restricting or banning the <em>\u201cpromotion\u201d<\/em> of homosexuality and gender change in media accessible to children, was adopted in accordance with the EU\u2019s own guidelines on protecting minors from harmful content. Budapest\u2019s interpretation of those rules, however, angered Brussels, with the EU Commission ultimately taking the case to the bloc\u2019s top court.\u00a0<\/p>\n<blockquote><p>\n        <span><strong>Read more<\/strong><\/span><\/p>\n<figure>\n            <imgsrc=\"\" alt=\"Tisza party leader Peter Magyar, slated to become the next Hungarian Prime Minister, Budapest, April 13, 2026.\"><figcaption><a href=\"https:\/\/www.rt.com\/news\/638496-hungary-magyar-media-crackdown\/\">Incoming Hungarian PM pledges crackdown on critical media<\/a><\/figcaption><\/figure>\n<\/blockquote>\n<p>The Court of Justice said it found the law in violation of the very values the EU is purportedly built upon and is <em>\u201cin breach of the freedom to provide and receive services.\u201d<\/em> Apart from that, the law entails <em>\u201crestrictions on freedom\u201d<\/em> and discriminates <em>\u201cbased on sex or sexual orientation,\u201d<\/em> stigmatizing and marginalizing people of\u00a0\u00a0<em>\u201cnon-cisgender persons.\u201d<\/em><\/p>\n<p><em>\u201cThe Court emphasizes, in particular, the margin of assessment that the Member States have, in the absence of harmonizing rules at the EU level, when defining the content, including audiovisual content, which is likely to impair the physical, mental, or moral development of minors,\u201d<\/em> the judiciary said in a statement, warning that said <em>\u201cmargin of assessment\u201d<\/em> must be exercised in line with the bloc\u2019s Charter.\u00a0\u00a0<\/p>\n<p>Budapest is now obliged to comply with the ruling and repel the law, the court said. Failure to comply may bring <em>\u201cfurther action seeking financial penalties,\u201d<\/em> it warned.\u00a0\u00a0<\/p>\n<p>The court\u2019s ruling is bound to become a major test for Magyar, who now must choose between his pro-EU commitments and the risk of angering Hungary\u2019s conservatives.
